Portugal ends in-country study residency pathways for foreign nationals

Portugal has moved to eliminate the in-country study pathway to residency, requiring foreign nationals to secure a consular study visa prior to arrival rather than regularizing after entering as tourists.

Closing the tourist-to-student regularization loophole

Under Law 23/2007, foreign visitors could enter Portugal on a short-stay visa or visa-free tourist entry and apply for a residence permit from inside the country after enrolling in secondary education, vocational training or level 4 and 5 qualification courses. That loophole allowed travelers to bypass consular processing abroad entirely.

The updated legislative measures revoke the in-country waiver.

Foreign nationals must now obtain an appropriate study or vocational residence visa from a Portuguese consulate in their home jurisdiction before traveling to the country. Arriving as a visitor and enrolling in a course afterward no longer provides legal grounds to regularize residence status.

Broader clampdown on post-arrival residence permits

The restriction follows the government's earlier revocation of the Manifestação de Interesse under Decree-Law 37-A/2024 in June 2024, which ended in-country regularization through employment. The 2026 foreigners law amendments target the remaining local conversion routes, ending residence applications based on vocational course enrollment, parentage of minor children born after arrival and automatic approvals triggered by agency processing delays.

Anyone planning residency pathways in Portugal can no longer rely on 90-day tourist stays to switch immigration tracks locally. Prospective students and career trainees who planned to register for classes after arrival must re-route their timelines and submit complete study visa applications to Portuguese consular posts abroad before entering the Schengen Area.
