What changed in Hong Kong's stay rules

Hong Kong’s Immigration Department updated its IANG and GEP extension rules in April, giving holders up to three months before expiry to file renewal requests. The new guidance also says applicants must leave Hong Kong when their limit of stay expires unless the Director of Immigration approves an exception, even if a renewal is still pending.
That makes the deadline stricter in practice. Overstaying is a criminal offense and can lead to prosecution and removal, the department said.
Who needs to watch the clock
The rules mainly affect foreign professionals on the Immigration Arrangements for Non-local Graduates and General Employment Policy routes, plus their dependants. IANG holders usually start with a 24-month stay, while GEP holders typically get 36 months at the outset.
The update matters most for people who travel often or rely on remote processing timing. Processing usually takes 2 to 3 weeks, but it can run longer during peak periods like summer, so a pending application doesn't stop the departure rule from kicking in.
How to file before expiry
Applications must be submitted online while the holder is physically in Hong Kong and the department says applicants should file at least six weeks before their stay ends. Standard evidence includes proof of degree-level work at market pay, business documents if relevant, a valid travel document and an employer support letter.
Fees are non-refundable and approval remains discretionary. Read our full Hong Kong guide for the complete picture and check our visa updates page for more policy changes.
