Two-tier property thresholds take effect
Executive Decree No. 17 of 2026 replaces the former single $300,000 real estate requirement with a bifurcated system based on building history. Investors purchasing secondary-market homes now face a $200,000 price hike to qualify for fast-track permanent residency. The baseline $300,000 tier remains strictly limited to first-sale, unoccupied properties purchased directly from a builder, developer or recognized successor.
Properties that have been rented, previously occupied or transferred to an unrelated third party automatically fall into the $500,000 bracket. Qualifying values depend on the lower of the purchase price and an independently supported commercial valuation, minus any registered liens. Paying $520,000 for a resale home won't satisfy immigration rules if an appraisal values the property at $480,000, legal filings show.
The Ministry of Commerce and Industries (MICI) can order an applicant-funded independent appraisal whenever registered cadastral data fails to reflect actual market conditions.
Stricter terms for pre-construction and alternative assets
Off-plan promises of sale remain eligible at the $300,000 level, though the decree imposes tighter developer guarantees. Investors who pay developers directly must secure an irrevocable, first-demand bank guarantee from a licensed Panamanian institution to protect their capital. If a developer defaults, buyers receive 180 business days from the contractual completion date to substitute an alternative investment.
Residency granted solely through off-plan contracts can't exceed three years total, per published regulatory texts.
Applicants choosing non-real estate routes must meet specific capital allocations across three categories:
Securities investments: $500,000 held on the Panama stock exchange for at least five years.
State bank fixed deposits: $500,000 placed directly with Banco Nacional de Panamá or Caja de Ahorros.
Private bank deposits: $750,000 in a five-year fixed-term deposit at an authorized private bank.
Grace periods for active contracts and solvency holders
Foreign buyers caught mid-transaction receive narrow transitional protection under the decree. Investors who finalized binding purchase contracts or perfected investments before Sept. 16, 2026 have a six-month window to file their residency paperwork under the prior $300,000 resale rules.
That administrative window closes March 16, 2027, requiring buyers with pending resale deals to submit their completed files promptly rather than delaying their immigration filings.
Long-term planning under Panama's residency rules also includes a 12-month window for holders of the Own Economic Solvency visa to convert to Qualified Investor status. Once approved, permanent residents face mandatory annual verifications. File submissions must reach MICI within the 30 calendar days prior to each residency anniversary.
If an investor liquidates their qualifying asset before the mandatory five-year holding period ends, they receive 90 calendar days to reinvest equivalent capital or face automatic status cancellation.
Fixed processing charges and decision timelines
The decree establishes expedited statutory timelines between MICI and the National Migration Service. MICI has up to 15 business days to issue its investment certification once an application is admitted, with applicants given 15 business days to cure file deficiencies.
Migration authorities must issue a final residency resolution within 30 business days of receiving the completed package. Legal representatives can file initial dossiers while applicants remain abroad, though in-person biometrics and foreign-national registration remain mandatory before residency cards are released.
Government processing charges remain separate from asset purchase costs:
Principal applicant: $5,000 payable to the National Treasury and a $5,000 repatriation guarantee deposited with the National Migration Service.
Dependents: $1,000 to the National Treasury and $1,000 to Migration for each accompanying family member.
