United Kingdom applies stricter visa rules to filings made starting Aug. 3

The United Kingdom will assess applications filed before Aug. 3 under the rules in force Aug. 2, while filings made Aug. 3 or later face amended, stricter requirements.

Filing date determines which rules apply

The transition covers entry clearance, Electronic Travel Authorisations (ETAs), permission to enter or stay, claims and administrative reviews, according to the Home Office’s July 9 statement of changes.

For online applications, the filing date is generally when the form is submitted. Postal applications use the posting date, courier applications use the delivery date and in-person applications use the date the office accepts them. Visa advisers treat fee payment as part of completing an online filing, so applicants seeking the older criteria should submit the form and pay by Aug. 2.

Travelers, workers and families are covered

The cutoff affects tourists seeking visitor visas or ETAs, students, work visa applicants and people extending or switching status inside the country. Family and Graduate route applicants are covered as well.

The United Kingdom still has no dedicated digital nomad visa. Stricter suitability tests start Aug. 3

Applications filed from Aug. 3 will be assessed under revised suitability provisions affecting criminal records, immigration history, overstaying and immigration bail. For ETAs, the amended rules include refusal or cancellation in certain cases involving suspended prison sentences of 12 months or more.

The Aug. 3 package also changes parts of the Student, Child Student, Skilled Worker, family and Graduate routes. Family provisions include care arrangements for children and permission periods for some partners, while Graduate route changes affect who can qualify as a dependant.

Separate changes to Appendix EU and Appendix EU (Family Permit) took effect July 30, so the Aug. 3 transition doesn't extend the previous rules for those earlier changes.
