The South African Department of Home Affairs (DHA) has issued Immigration Directive No. 7 of 2026, offering a major sigh of relief for foreign nationals caught in the country’s administrative backlog. Contrary to earlier fears that temporary concessions would expire, the government has extended lawful stay protections for those with pending applications and appeals.

This extension serves as a vital buffer while the DHA continues to process a significant volume of paperwork. Under the new directive, foreign nationals with pending long-term visas, waivers, and appeals are granted a temporary extension of their legal status until June 30, 2027. This prevents applicants from being declared "undesirable" or facing penalties due to processing delays beyond their control.

Who is covered by the extension

The directive specifically applies to individuals who submitted their applications via VFS Global and were awaiting a decision as of March 30, 2026. This includes:

  • Digital nomads and remote workers awaiting long-term visitor visa outcomes.
  • Expats on work, study, or relative visas who have filed for renewals or waivers.
  • Individuals currently appealing a visa rejection.

It is important to note that short-term tourist visas (section 11(1)(a)) are handled differently. If a tourist visa appeal has been pending for more than three months, the applicant must depart South Africa by April 30, 2026, to avoid being blacklisted.

Practical steps for nomads and expats

If you are currently in South Africa under these concessions, you must adhere to the conditions of your original visa. For example, if your initial visa did not permit work, you cannot begin working while your new application is pending.

To maintain your status, keep your VFS receipt and proof of application on you at all times. If you need to travel internationally, you can exit and re-enter South Africa by presenting these documents at the border. However, travelers from non-visa-exempt countries must still apply for a port-of-entry visa at a South African mission abroad before returning.
