Saint Helena caps Holiday Permit stays at 183 days without work rights

Saint Helena approved comprehensive immigration reforms that replace its short-term visitor scheme and consolidate long-term employment permissions, Governor Nigel Phillips confirmed on Aug. 3.

Replacing split permissions with a unified five-year permit

The Immigration (Amendment) Ordinance 2026, passed by the Formal Legislative Council on July 17, overhauls the island's previous entry rules under the Immigration Ordinance 2011.

Under the previous framework, foreign workers had to secure separate long-term entry permits, work permits and immigrant employment certificates. The amended ordinance merges those three tracks into a single Permission to Stay and Work Permit, valid for up to 5 years and extendable upon application.

Authority shifts away from the former Immigration Control Board directly to the Chief Immigration Officer, who now manages approvals, administrative reviews and asylum claims.

Stricter visitor rules and rental limits

For remote workers and seasonal travelers exploring Saint Helena's residency rules, the legislation introduces a formal Holiday Permit to replace standard short-term entry permissions:

• Initial stay limit: Grants an entry period of up to 183 days, with extensions capped at 365 days.

• No local employment: Holders can't undertake paid work, though unpaid volunteering for registered charities is permitted for up to 30 days.

• Discretionary leave: Immigration officers can issue temporary emergency extensions for unforeseen travel disruptions or essential short-term specialist tasks.

Because local property regulations under the Immigration Control Ordinance 2008 bar non-residents from signing residential leases that outlast their immigration documents, your housing duration matches your permit exactly. Visitors on a standard Holiday Permit can't enter long-term residential lease agreements beyond 183 days without an official extension.

The ordinance takes effect once the Governor publishes an official commencement order. Existing permit holders don't need to reapply immediately, as all current entry and residence permissions remain legally valid until their original expiration dates.
